Terms of service
These terms of service apply to all offers, agreements and services of VisaElevate™: advice, checking documents, preparing and submitting visa and residence applications, flight assistance and all other services. Please read them before you ask us to start.

1. Who we are
VisaElevate™ is a trade name and part of ElevateInter™, registered with the Netherlands Chamber of Commerce (KvK) under number 98955411 ("VisaElevate", "we" or "us"). "You" or "client" means the person who requests or uses a service from us.
VisaElevate™ is a private visa and immigration consultancy, not affiliated with any government agency. We do not give legal advice, but we can put you in touch with qualified legal professionals.
2. Scope
These terms apply to every offer we make and every agreement with us, including additional and follow-up assignments. Different arrangements only apply if we have confirmed them in writing (including by e-mail). Your own general terms do not apply.
If a provision is void or annulled, the other provisions remain in force. We then replace it with a valid provision that comes as close as possible to its purpose.
Spelling or typing errors, unclear wording or omissions in these terms or in a translation do not affect the other provisions; such a provision is interpreted according to its purpose.
3. Our services
We give advice, tell you which documents you need, check the documents you provide and help you prepare and submit your application. For flights we look for suitable options and help with booking and assistance.
Before we start, we confirm by e-mail which service you get, what it costs and what is included. That confirmation and these terms together form the agreement.
We work professionally, honestly and in good faith, within the applicable laws and regulations, and do our work to the best of our ability and with care (an obligation of effort). We do not promise a particular result. Our advice is based on the rules and information known at that time; the rules and policies of authorities can change.
General information on our website and in guides, checklists and news is not personal advice. We keep it as up to date as we can, but are not liable for errors or outdated information in it.
4. The decision is not ours
All decisions on applications are made by the competent authorities, such as the IND, embassies, consulates and visa application centres. We cannot guarantee approval, a processing time or an appointment date. A refusal, delay or withdrawal by an authority does not give a right to a refund or compensation, unless we agreed otherwise in writing.
5. What we expect from you
You give us correct, complete and up-to-date information and only genuine documents in good time, and you tell us straight away about changes that matter for the application. You are responsible for the content of what you provide and for what you submit to and sign for authorities.
You keep your original documents yourself, unless we agree otherwise.
If we suspect incorrect, misleading or forged information or documents, we may stop the service immediately. Work already done remains payable. You indemnify us against claims by third parties and costs resulting from incorrect or incomplete information or documents from you.
6. Fees and payment
We agree our fees per service in advance. They exclude all embassy, visa and government charges and the costs of third parties, such as visa application centres, translations, legalisation, couriers, insurance and tickets. You pay those yourself, or to us as an advance.
We may ask for payment in advance. Some steps in the client portal only open once the payment for that step has been received. Invoices are payable within 14 days of the invoice date.
If you do not pay on time, we send you a reminder with a new term of 14 days. If you still do not pay, you owe the statutory interest and the extrajudicial collection costs under the law. While an invoice is unpaid, we may suspend our work.
We may change our fees. The agreed fee applies to an ongoing agreement.
7. Third parties and AI
We may engage third parties for (part of) the work, such as (sworn) translators, legalisation and courier services, legal professionals, airlines, travel agencies and providers of hosting, e-mail, storage, software and AI. We choose them with care and work with them in good faith. They work under their own terms and responsibility; we have no control over their work, timelines and systems, and no system is completely secure. We are not liable for acts or omissions of third parties, such as errors, delays, outages, data breaches or other incidents on their side. We may accept their terms, including limitations of their liability, also on your behalf.
Where possible we use AI tools, for example for translations, checks and drafting texts. An employee checks the outcome. How we handle your data in doing so is described in our privacy policy.
8. Cancellation and the right of withdrawal
You can always end the agreement by e-mail. We charge the work done until that moment and the costs we have already incurred for you. Documents and other work we prepared for you are delivered once the invoice has been paid.
If you are a consumer, you may withdraw from a distance contract within 14 days without giving a reason. If you expressly ask us to start within those 14 days, you pay a proportionate amount for the work done until you withdraw. Once the service has been fully performed at your request, the right of withdrawal ends. There is no right of withdrawal for flight tickets and other travel services on a specific date; the terms of the airline or provider apply to those.
We may end or suspend the agreement if you do not keep to your obligations, if a payment is not made, or if we can reasonably no longer cooperate with the application, for example on suspicion of fraud.
9. Personal data and confidentiality
We ask for personal and special data, such as data about your relationship, health, children and criminal record, because we need it to help you with your visa application, booking flights and our other services. How we handle it, with whom we share it and how long we keep it is described in our privacy policy, which forms part of these terms.
We handle your data carefully and confidentially, and this is very important to us. By accepting these terms you give us your explicit consent to process the (special) personal data you give us, such as data about your relationship, health, children and criminal record, for your application, booking flights and our other services. You can always withdraw this consent; without that data we may not be able to provide the service (in full).
We may keep data when the law requires it, for a follow-up or future application, for the archive of earlier applications and to be able to defend ourselves, as described in the privacy policy. As long as an invoice is unpaid, we keep your file, with the documents and work we prepared for you, also if you ask for erasure or a copy; we deliver that work after payment. For manifestly unfounded or excessive requests and for further copies we may charge a reasonable fee.
10. Security and your account
We take appropriate technical and organisational measures to protect your data and documents. A completely secure system does not exist; we cannot guarantee that an incident will never occur.
You keep your sign-in details secret and protect your own devices and e-mail. We are not liable for damage from misuse of your account caused by an error on your side, or from documents you send yourself through unsecured channels (such as ordinary e-mail or WhatsApp).
11. Liability
We work carefully, honestly and according to the applicable rules. If something still goes wrong, the following applies.
Our liability is in all cases limited to the amount our liability insurance pays out in that case or, if nothing is paid out, to the amount you paid us for the service concerned.
We are not liable for indirect or consequential damage, such as loss of income, missed trips, extra travel and accommodation costs, costs of new applications or fees, and non-material damage.
We are not liable for decisions, delays, changes in rules or policy, or errors of authorities, embassies, visa application centres, airlines or other third parties; for acts or omissions of our partners and providers (section 7); for damage caused by incorrect or incomplete information or documents from you; or for damage caused by an incident over which we have no influence.
You must report a complaint or claim to us in writing within a reasonable time after you discovered, or should reasonably have discovered, the shortcoming. Any claim against us expires one year after you became aware, or could reasonably have become aware, of the facts on which it is based.
These limitations do not apply in case of intent or gross negligence on our part, nor to the extent mandatory law does not allow a limitation.
12. Force majeure
We are not liable if we cannot keep (on time) to our agreements because of circumstances beyond our fault or control, such as decisions or disruptions of authorities, closed embassies, strikes, illness, pandemics, natural disasters, war, failures of the internet, power or third-party IT services, and cyber attacks. If force majeure lasts longer than 60 days, either party may end the agreement. Work already done remains payable.
13. Intellectual property
All intellectual property rights in our website, the portal, the guides, checklists, templates, texts, advice, software, designs, logos and the brands VisaElevate™ and ElevateInter™ belong to us or our licensors.
You may use the documents, letters, forms, translations, advice and other work we make for you for your own application once it has been paid. You may not copy, distribute, sell, publish, automatically extract (scrape) or use our content to train AI models without our written permission.
We may reuse templates, texts and working methods we develop for other clients, without your personal data.
Documents you provide remain yours. You give us the right to use them as far as needed for our services.
14. Questions and complaints
Not satisfied? E-mail us at info@visaelevate.com. We confirm receipt and reply within 14 days with a solution or a clear explanation.
15. Changes, applicable law and language
We may change these terms. For an ongoing service, the version in force when the agreement was made applies, unless a change is in your favour or required by law.
Dutch law applies to all offers and agreements. Disputes are submitted to the competent court in the Netherlands, without affecting the mandatory protection you have as a consumer in your own country.
These terms are available in several languages. If the versions differ, the Dutch version prevails.
